In 1993 congress enacted the EB-5 Regional Center “Pilot Program” into law. This program would allow foreign EB-5 Investors and their qualifying relatives (husband/wife and any unwed children under the age of 21) to become Lawful Permanent Residents of the US.  The US Citizen & Immigration Service governs the program.  There are 10,000 EB-5 visas available each year, of which 700 visa petitions were submitted in 2007.   As development funding became more difficult in the United States through the 2008 recession, awareness of the program grew substantially. The number of visas petitioned for has escalated sharply, and 10,928 visa petitions were submitted in 2014. Over 90% of all visa petitions are filed through a Regional Center.
EB-5 Regional Centers: EB-5 Regional Centers must apply to the USCIS (US Citizen & Immigration Service) and be approved to market investment projects and seek investors.  The USCIS continuously analyzes all investment projects presented by Regional Centers.  The Centers must submit business plans, fee structure, job creation, and more for each individual project.
Requirements: EB-5 Investors are accredited investors from all over the world.  There are three initial requirements of all EB-5 Investors:
  • The EB-5 Investor makes an investment of at least $500,000 in a Targeted Employment Area (TEA), or $1,000,000 if not in a TEA.
  • The EB-5 investor must prove the money for this investment was earned legally/legitimately.
  • The investment must create 10 new jobs within the United States of America.
